Welcome to ChaloSaath. These Terms & Conditions ("Terms") govern your use of the ChaloSaath Platform available at www.chalosaath.in and its related services. By creating an account, listing a service, or placing a booking, you agree to these Terms. Please read them carefully.

1. Who We Are

ChaloSaath is an intermediary platform, based in India, that connects travelers with independent vendors (stays, rentals, guides, verified taxi services, travel-essentials sellers) and with independent trip managers. We also provide tooling such as the AI Trip Planner, Trip Assistant, Stories and a Trip Manager Marketplace. ChaloSaath itself does not own, operate, or provide the underlying travel services; we facilitate discovery, planning, booking, messaging, and content-sharing between you and third-party vendors. We welcome both Indian and international travelers.

2. Eligibility

• You must be at least 18 years old and legally capable of entering into a binding contract.
• You agree to provide accurate, current, and complete information about yourself and keep it updated.
• You are responsible for maintaining the confidentiality of your account credentials and OTPs.

3. User Responsibilities

• Use the Platform lawfully, honestly, and respectfully.
• Do not post content that is illegal, defamatory, obscene, discriminatory, misleading, or that violates any person's rights.
• Do not attempt to hack, scrape, disrupt, or reverse-engineer the Platform.
• Do not impersonate any person or entity, or create fake accounts.
• Follow all applicable travel, transport, and destination regulations during your trip.

4. Vendor & Trip-Manager Responsibilities

• Provide accurate, complete, and current information about the services you list (pricing, availability, pickup points, inclusions, exclusions, vehicle condition, qualifications, etc.).
• Hold all licences, permits, registrations, insurances, and tax registrations required by Indian law for the services you offer.
• Honour confirmed bookings, respond to traveler queries within a reasonable time, and deliver services that match the listing description and quality.
• Vendor verification is a mandatory step — we review identity, business proof and at least one listing before enabling the Verified badge. Additional tiers (Rising Star, Top Vendor) are earned based on bookings, ratings and response quality. Trip Hosts (group-trip organisers) and taxi-service vendors clear an equivalent admin-review process before publishing.
• Trip managers must accurately declare the languages they speak, their experience, and whether they accompany the trip or only plan it. These fields are used for traveler matching.
• Comply with our Community Guidelines and Safety Guidelines at all times.
• You alone are responsible for the services you provide. ChaloSaath does not supervise or control day-to-day delivery of your services.

5. Bookings & Payments

• Bookings are a request-and-confirmation process. A booking becomes binding only after the vendor or trip manager accepts it.
• Payments happen via manual UPI — you pay directly via UPI and upload the UTR / screenshot as proof, which ChaloSaath verifies and releases to the vendor. ChaloSaath does not integrate with any payment gateway, does not hold card or bank credentials, and does not process gateway payments.
• ChaloSaath may collect a Booking Protection Fee (charged to the traveler) and a Platform Fee (charged to the vendor) as disclosed to you at the time of booking.
• All prices are in Indian Rupees (INR) and inclusive of applicable taxes, unless stated otherwise.

6. AI Trip Planner

The AI Trip Planner is an assistive feature. It generates itineraries, budget estimates and suggestions based on your inputs using third-party large language models. AI output may be incomplete, inaccurate or outdated — it must not be treated as professional travel advice. Always verify permits, seasonality, safety warnings, and availability with a trip manager or directly with the vendor before committing to a plan. ChaloSaath is not liable for losses arising from reliance on AI-generated content.

7. Content You Post

You retain ownership of the photos, reviews, stories, and messages you post. By posting, you grant ChaloSaath a worldwide, royalty-free, non-exclusive licence to host, display, reproduce, and distribute that content for the purpose of operating and promoting the Platform. You represent that you have the right to share the content and that it does not infringe any third-party rights.

8. Third-Party Services

The Platform integrates with third-party services (e.g. Google sign-in, maps, weather, AI-based planning, email delivery, object storage). ChaloSaath is not responsible for third-party services, their availability, accuracy, or data-handling practices. Your use of third-party services is governed by their own terms.

9. Limitation of Liability

• ChaloSaath provides the Platform "as is" and "as available". We do not guarantee uninterrupted access, error-free operation, or specific outcomes.
• ChaloSaath is not a party to any transaction, trip, or service between a traveler and a vendor or trip manager. We do not guarantee the quality, safety, legality, or successful execution of any listing, trip, rental, hire, or taxi service.
• To the fullest extent permitted by Indian law, ChaloSaath and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform or any third-party service booked through it.
• Our aggregate liability for any claim will not exceed the total amount of platform fees you have paid us in the 3 months preceding the claim, or INR 5,000, whichever is lower.

10. Indemnity

You agree to indemnify and hold harmless ChaloSaath and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of (a) your use of the Platform, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) any content you post.

11. Account Suspension & Termination

We may suspend or terminate your account — with or without notice — if we reasonably believe you have violated these Terms, our Community Guidelines, or applicable law, or if your activity poses a risk to other users or to the Platform. You may close your account at any time from your dashboard or by writing to support@chalosaath.in.

12. Intellectual Property

The ChaloSaath name, logo, brand marks, and Platform design are our intellectual property. You may not copy, modify, or use them without our prior written permission, except for lawful personal use of the Platform.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts at New Delhi, India. The parties will first attempt to resolve disputes amicably through written communication to support@chalosaath.in within 30 days.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and update the "Last Updated" date. Continued use of the Platform after changes means you accept the updated Terms.
